Chanel Jersey lose trademark battle
Fashion brand Chanel lost her fight for brand name "Jersey" for his latest perfume.
Intellectual Property Office of the United Kingdom have the Chanel refused to meet Jersey Department of Economic Development.
The fashion house still call the product "Jersey", but will not have the name.
Chanel argued that they have a history, their perfume after an important concept, its founder, Coco Chanel call. In the case of "Jersey" Coco was famous for introducing the jersey fabric in the world of haute couture.
Martin Hamilton, Secretary of the Society for Chanel said: "The consumer will easily associate the reputation of Chanel jersey fabric in his clothing lines with the use of the Chanel" jersey "perfume brand."
However, said Darren Scott, Director of Strategy for Economic Development in Jersey, said: "Demand for Chanel was in contrast to the 1994 law on trade marks because the word" Jersey "is the geographical origin of products, namely the Channel Island of Jersey."
He went on to say that the name "Jersey" is likely to mislead the public as to the geographical origin of the products that the products are manufactured on the island, or contain ingredients that are grown.
UK IP Office ruled in favor of the Department of Economic Development of Jersey and demand of Chanel brand "Jersey" was denied.
Senator Alan Maclean, Minister for Economic Development said: "We are not against the principle of Chanel with jersey for their products, of course, is a very good thing in many ways to the island.
"What we did was against the use of the mark and the registration of the mark, because if they do, to prevent potential companies on the island in the UK market in the future and use jersey on behalf of their products, the Class 3, these products such as cosmetics, perfumes are.
"We do not want to limit the opportunities for entrepreneurs Jersey."
